U.S. District Court Denies Motion To Dismiss Mitsubishi Lawsuit Against GE

Mitsubishi Heavy Industries Ltd. and Mitsubishi Power Systems Americas Inc. are reporting that the U.S. District Court's Western District of Arkansas has denied a motion by GE to dismiss Mitsubishi Heavy Industries Ltd.'s litigation that charges GE with seeking to monopolize the market for variable-speed wind turbines in the U.S.

‘The judge's denial of GE's motion will ensure that a judge will hear the facts of a case that describes how GE seeks to monopolize the market for variable-speed wind turbines in the United States,’ says Sonia Williams, spokesperson for Mitsubishi Power Systems Americas. ‘The judge did decide to stay discovery for the present. Nevertheless, we are heartened by his suggestion that he may terminate the stay if he finds appropriate circumstances.’

In the complaint filed this summer, Mitsubishi alleges that after Mitsubishi gained a foothold in the U.S. market in 2006, GE embarked on an unlawful anti-competitive scheme to drive Mitsubishi suppliers out of the U.S. market.
